Eh, I'm neutral on this. I don't think Frampton has any right to tell the fan not to film it on his phone. If the guy had an actual camera and was filming, that'd be bootlegging and Peter'd have every right to intervene. But recording on a phone is like asking a three year old to paint the Mona Lisa -- it's of such shitty quality it's just a personal memento and cannot be considered legitimate bootlegging. Yes this stuff might end up on Youtube but nobody is selling phone footage. So it's not really Peter's jurisdiction as far as I'm concerned.
Me, I personally hate that people film shows on their phones because it seems to have made actual, legitimate concert recording less ubiquitous. But I'll be damned if I'm going to tell someone how to enjoy their concert. That's plain fascism, let people enjoy themselves at the show they paid for.
