Cheap Trick have launched a countersuit against drummer and archivist Bun E Carlos after he started court action last month.

Carlos claims he reached a deal with Rick Nielsen, Tom Petersson and Robin Zander three years ago that meant he’d no longer tour with them, but he’d remain part of the band business.

He was left furious after they later recorded a track without him, which he says wasn’t part of the arrangement. In July he and former manager David Frey filed legal papers citing “defendants’ outright refusal to account for, or pay, hundreds of thousands of dollars which are owed to each of the plaintiffs, or to otherwise comply with their obligations to plaintiffs.”

On Friday the three active band members submitted their own documents at the Court of Chancery in Delaware, asking for a judgement that Carlos was removed as a director of Cheap Trick Unlimited Inc and two other corporations in a valid manner.

In 2010 the band announced: “Bun E Carlos is not currently the touring drummer for Cheap Trick. Bun E remains a band member. Everyone is healthy and Cheap Trick will continue to tour as planned.”

The sticksman later said: “Solely as an accommodation to some of the band members I reluctantly agreed to take a temporary hiatus from touring.” Last year he spoke about his hopes that they’d resolve their differences.

Neilsen’s son Jaxx has been playing drums for Cheap Trick since Carlos’ departure.

Doesn't surprise me they countersued. Bun E wants to leave the band, but he doesn't want to give up the $$$ and control.


I feel he shouldn't have control over any new material.......we'll see what the courts say (probably 10 years from now)

Kind of a shame. Except for Peterssen leaving to do solo work in the 80's, those original four always seemed pretty inseparable, in stark contrast to so many other bands.

That's too bad it's come to this. You'd think by now they have enough money they don't need to have to deal with this kind of BS.
