SAN DIEGO — Divorce documents show that the lead singer of metal band As I Lay Dying had an amicable split with the estranged wife he's now accused of trying to hire a hit man to kill, but she was concerned about how recent changes in his behavior would affect his parenting.

Meggan Lambesis, the wife of Tim Lambesis, said in the court papers obtained by The Associated Press on Wednesday that she worried about his ability to care for their three adopted children, but she gave no indication she felt in danger.

Law enforcement officials said they arrested Tim Lambesis after receiving a tip last week that the 32-year-old singer – who is covered in tattoos and known for his growling voice – was plotting to kill his wife, who filed for divorce in September.

Authorities said Lambesis tried to hire an undercover detective he believed was a hit man, and he was arrested Tuesday while shopping at a store in Oceanside.

The couple adopted the children – ages 4, 8 and 10 – from Ethiopia, and Tim Lambesis continued to see them for about 10 hours a week when he was not on tour, even though the couple was no longer living together, according to court documents.

Meggan Lambesis said her estranged husband had become "obsessed with bodybuilding" and was distracted while with the children, often texting or talking on the phone. She noted he had fallen asleep while watching them at the beach or near the pool and said they need a "stable parent" to help them adjust to their new life and country.

She said he tours six months out of the year and had traveled across the country twice in one year to visit a girlfriend. She said he also had spent thousands of dollars on tattoos. Both had agreed to private mediation to discuss the children's custody.

Tim Lambesis' comments about his Grammy-nominated band's latest album, "Awakened," indicate he may have been struggling.

The band's website says the album – released the same month his wife filed for divorce – is a "far darker, more pessimistic beast" compared to previous albums.




"On this record, I wasn't purposefully trying to be negative, but I think sometimes we have to be honest with some of the darker and more difficult times of our lives to get back to that positivity," Lambesis is quoted as saying. "While the lyrics do perhaps seem like a dark window into my soul, they're written that way specifically because I want to move on and transcend those difficult moments in life."

Authorities said a task force from several law enforcement agencies launched an investigation that led to the arrest late Tuesday. The department would give no further details.

A man who answered the phone at a number listed in the singer's name in Del Mar said the family was not commenting at this time.

Lambesis was scheduled to be arraigned Thursday in Vista. His attorney could not be reached for comment.

As I Lay Dying formed in San Diego in 2000 and has released six albums, including 2007's "An Ocean Between Us," which reached No. 8 on Billboard's charts. A single from the album, "Nothing Left," was nominated for a Grammy for top metal performance.

The band, which plays in an aggressive style that features metal guitar riffs at the furious pace of hardcore punk, was scheduled to tour the country this summer.

Its record label, Metal Blade, said in a message posted to the band's fans that "there are many unanswered questions, and the situation will become clearer in the coming days and weeks."

"We'll keep you informed as best we can," the message said. "Our thoughts right now are with Tim, his family, and with everyone else affected by this terrible situation – and with our fans, whom we love and draw strength from."

I'm really shocked people think this idiot is innocent and there are people calling his wife a bitch. Grow up. The guys is guilty and asked an undercover cop to do the killing thinking he was a hitman. Something like this happened in NJ a few weeks ago. If his wife is a bitch it still doesnt give him the right to have her killed. What a twat.

I've lost count of how many movies have been done with this theme over the years, you'd think people would learn from history.

I don't know anything about the band, not my kind of metal but they'll need a new singer after this sordid business goes to trial.

At least they're not trying paint the guy a certain way for the public at large that has no idea who he is.

hes a singer in a "metal" band. christian metal/metalcore band. not a fan of them never was. this guy is just a jack ass and the fact people are trying to justify this type of asinine behavior is appalling.

Well for one thing, I just checked out his band, so let's not call him a "singer"....Placido Domingo is a singer, or Van Morrison, or Robert Plant.... I can also growl and make a vomiting noise with my throat, and make myself sound like a garbage disposal unit, but that doesn't make me a "singer".

But where do all these stupid people find their hitmen?? Haven't they watched enough news to know that 90% of them are cops? What a dumb@$$. On the bright side, he should sell some records now, though they probably need to change the name of the band to 'As I Lay in a Prison Bed' ....and anyway it looks like he just became a blues singer. :gg:

As I Lay Dying vocalist Tim Lambesis has been sentenced to six years in prison for attempting to hire a hitman to murder his estranged wife. The sentence was handed down earlier today (May 16) by Judge Carlos Armour of the San Diego Superior Court.

In February, Lambesis pleaded guilty to murder-for-hire charges. He was originally slated to be sentenced on May 2, but the hearing was delayed until today. Lambesis faced up to nine years in prison, but was given six during today’s sentencing.

As the verdict was handed down, As I Lay Dying bandmates Nick Hipa, Phil Sgrosso and Josh Gilbert looked on. Many supporters of Lambesis’ estranged wife Meggan were also in attendance, making their presence known by wearing yellow felt hearts pinned to their shirts.

One supporter was Meggan’s father, Mike Murphy, who was the first to speak to the court. Mr. Murphy shared that the family still fears Meggan’s assassination, stating, “We know that prison is a great alibi for someone who wants to complete the deed.” Murphy added, “He was only worried about the money. Tim is only sorry he got caught,” before asking Judge Armour for the maximum sentence of nine years.
Meggan’s mother also spoke at the hearing, claiming that Lambesis was an abusive husband and regarded Meggan as “a mere inconvenience to this narcissistic child.”

Meggan herself also spoke, stating that Tim had become “dangerous” and that she “felt as fragile as a piece of paper that could float away at any moment.” Meggan also explained that the day before Tim’s arrest, the vocalist texted her asking for their three adopted children’s social security numbers in a display of “tying up loose ends.” Meggan even referenced the Arnold Schwarzenegger film ‘Total Recall,’ where he shoots his wife and says, “Consider that a divorce.”

When Tim Lambesis was allowed to speak, the vocalist struggled to speak as he openly wept. “I do feel deep remorse,” said Lambesis. “I want to thank you. For her prayers, which proves you still have the heart that you do.” Lambesis also noted that he wasn’t able to verbally apologize to Meggan in the past due to restraining orders.

In the end, Lambesis was given six years in prison with 48 days credit for time already served. Tim and Meggan’s children were given 10 years of protection. Lambesis will also return to court while incarcerated for a civil suit against him, where Meggan is asking for $2 million.

Meanwhile, Lambesis’ As I Lay Dying bandmates recently formed a new a band called Wovenwar with vocalist Shane Blay.

I'm not a fan of As I Lay Dying, but Lambesis did release some fun albums with his Austrian Death Machine project, which is basically thrash with parody/tribute lyrics to Arnold Schwarzenegger's films.

As for the sentence, I guess he got what he deserved!
